Two reasons.
First, since the trial, there
has been so much come to light
as to false evidence that was
presented by the DA,
exculpatory evidence that was
not disclosed, and expert
testimony that was 'doctored'
prior to being presented to
the jury, that the parents
lawyers have advised them that
getting a verdict in their
favor is far from a sure
thing.
Second, and more important, a
lot of the exculpatory
evidence has been 'leaked' to
the defense by people at the
Modesto PD or the DA's office
by what are, strictly
speaking, illegal means. That
means that the defense cannot
use that evidence in an
appeals motion. If, however,
the wrongful death suit
proceeds, the defense can
depose the people at the DA's
office and MPD, and get the
exculpatory evidence entered
into the record. That then
makes it legally available to
the defense for use in an
appeal motion. Laci's parents
still believe he did it, so
they don;t want to do anything
that might result in evidence
that he didn't getting into
the record.
Against this, they have to
balance the fact that Scott
still has substantial funds
available to pay for his
appellate lawyers. A wrongfull
death suit judgment could
seize those funds, making it
much harder for him to proceed
with an appeal.
They balanced the possible
advantages of stripping him of
the money to mount a strong
appeal against the
disadvantages of possibly
providing him with more
evidence to use at that
appeal, and decided that
keeping the exculpatory
evidence quiet was more
important.
